Well there’s spam and then there’s marketing. Email marketing to past customers is one of the few ways for small businesses to control their own message. So if you block those emails, you are actually hurting their reputation. Too many and they’ll be blocked by their service (ie MailChimp).
On the other hand, if you never consented to get an email from them and they still email you regularly, then marking it as spam is being honest.
For the record, I always ask if I could add someone to our mailing list yet still get people who mark us as spam. It happens. We just do our best to make our emails worth reading.
