Is that even legal? I guess it would be a 1099 for that amount. I didn’t ask why. I don’t plan to do it but I’m not sure what reason to give other than I don’t want to make more work for myself.

Why would it not be legal? The employee elects withholding amounts and can change it anytime throughout the year depending on their tax situations. If employee wants to be exempt this pay period have them fill out a new W4 and then another one when they need taxes taken out.
